These Terms of Service (“Terms”) govern your access to and use of shopcaivera.com and your purchase of products from Caivera. By browsing the site, creating an account, or placing an order, you agree to these Terms.

If you do not agree, do not use the site or place an order.

Orders are sold and dispatched by CAIDAN BARRICK TY INC from the United States.

If there is a conflict about shipping, the Shipping Policy controls. If there is a conflict about returns, exchanges, or refunds, the Return & Refund Policy controls. If there is a conflict about personal information, the Privacy Policy controls.

3. Eligibility
You must be at least 18 years old, or the age of majority in your state, to place an order. If you use the site on behalf of a business, you represent that you have authority to bind that business to these Terms.

4. Products
We sell jewelry, including necklaces, earrings, and rings. Product titles, descriptions, metals, finishes, measurements, and photographs are provided to help you choose an item. Colors and finishes may look different on your screen because of lighting and device settings.

Jewelry is a decorative accessory. It is not a medical device and is not intended to diagnose, treat, or prevent any condition. If you have a metal sensitivity, review the product materials before purchase. Stop wearing an item and contact us if irritation occurs.

Unless a listing states otherwise, items are not personalized. Custom, engraved, or made-to-order pieces, if offered, are subject to the exceptions in the Return & Refund Policy.

5. Pricing and Taxes
Prices are shown in U.S. dollars. We may change prices at any time before an order is accepted. The price charged is the price displayed at checkout when you submit the order, plus applicable shipping and taxes.

Sales tax is calculated at checkout where required. Shipping charges are shown before payment and follow the Shipping Policy.

An advertised promotion applies only as stated on the site and only if the order meets the stated conditions. We may cancel an order that uses an invalid, expired, or ineligible code.

6. Orders and Acceptance
An order is an offer to buy. Submission of an order does not complete the contract until we accept it. We may refuse, cancel, or limit an order if:

  • the item is out of stock or listed in error
  • we cannot verify payment or contact information
  • the order appears fraudulent or abusive
  • we cannot ship to the address provided
  • the order violates these Terms

If we cancel after payment has been captured, we will refund the amount paid for the cancelled portion.

We may contact you at the email or phone number provided at checkout to confirm details. If we cannot reach you, we may cancel the order.

7. Payment
We accept the payment methods displayed at checkout. Payment is processed by third-party payment providers. You represent that you are authorized to use the selected method and that the information you provide is accurate.

We do not store full card numbers on our servers. Authorization, capture, and fraud checks are handled by the payment provider.

If a payment is reversed, charged back, or fails after shipment, you remain responsible for the unpaid balance and any reasonable collection costs permitted by law.

8. Shipping
We ship to residential and commercial addresses in the fifty United States and the District of Columbia only. We do not ship to APO, FPO, or DPO addresses, U.S. territories, international addresses, or post-office boxes that cannot accept the selected carrier service.

Processing, rates, delivery estimates, tracking, address changes, undeliverable parcels, loss, and in-transit damage are described in the Shipping Policy. Estimated delivery dates are estimates, not guarantees.

Title and risk of loss pass to you when the carrier delivers the parcel to the address provided at checkout, except where applicable law provides otherwise. If a parcel is marked delivered and you have not received it, follow the Shipping Policy.

9. Returns, Exchanges, and Refunds
Returns, exchanges, and refunds are handled under the Return & Refund Policy. You must obtain approval before sending an item back. Unapproved shipments may be refused or returned to you at your expense.

10. Cancellations Before Shipment
If your order has not yet shipped, email service@shopcaivera.com as soon as possible with your order number. We will cancel if the order has not entered packing or carrier transfer. Once a label is created or the order has shipped, the Return & Refund Policy applies.

11. Product Care and Use
Jewelry may scratch, tarnish, fade, or loosen with wear. Avoid water, perfume, lotion, chemicals, and abrasive surfaces unless the product description states the item is suitable for those conditions. Follow any care card included with the item.

We are not responsible for damage caused by misuse, accidents, improper storage, unauthorized repair, or normal wear after delivery, except as required by law or as stated in the Return & Refund Policy for manufacturing defects.

12. User Accounts and Conduct
If you create an account, you are responsible for maintaining the confidentiality of your login details and for activity under the account. Notify us promptly if you believe the account has been used without authorization.

You agree not to:

  • use the site for any unlawful purpose
  • interfere with the site, checkout, or other users
  • scrape, harvest, or copy content except as allowed by ordinary browser use
  • submit false, misleading, or fraudulent order or claim information
  • upload malware or attempt to gain unauthorized access
  • misuse promotional codes

We may suspend access or cancel orders if we reasonably believe these rules have been violated.

13. Intellectual Property
The Caivera name, logos, product photographs, descriptions, graphics, and site content are owned by us or our licensors. You may not copy, reproduce, republish, sell, or exploit that content without our prior written consent, except for personal, non-commercial use of pages as displayed.

Product designs and listings do not grant you any right to reproduce the jewelry or our branding.

14. User Content
If you send reviews, photos, questions, or other content to us, you grant CAIDAN BARRICK TY INC a non-exclusive, worldwide, royalty-free license to use, display, and reproduce that content in connection with the store and our products. You represent that you own the content or have permission to grant this license, and that it does not infringe anyone else’s rights.

We may decline or remove content that is unlawful, misleading, offensive, or unrelated to our products.

15. Disclaimer of Warranties
The site and products are provided “as is” and “as available,” except for any written warranty in the product listing or rights you have under the Return & Refund Policy or applicable law.

To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or free of harmful components.

Some states do not allow certain warranty disclaimers. In those states, this section applies only to the extent permitted.

16. Limitation of Liability
To the fullest extent permitted by law, CAIDAN BARRICK TY INC, its officers, employees, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of your use of the site or any product.

Our total liability for any claim arising out of an order or these Terms will not exceed the amount you paid for the product giving rise to the claim.

These limits do not apply to liability that cannot be limited under applicable law, including liability for fraud or for personal injury caused by our negligence where such a limit is prohibited.

17. Indemnity
You agree to defend and indemnify CAIDAN BARRICK TY INC against claims, damages, and reasonable legal fees arising from your misuse of the site, your violation of these Terms, or your infringement of another person’s rights, except to the extent caused by our own misconduct.

18. Force Majeure
We are not liable for delay or failure caused by events beyond our reasonable control, including carrier disruption, weather, public holidays, labor disputes, power or network outages, supply shortages, or government action. We will resume performance when reasonably possible or cancel and refund as appropriate.

19. Electronic Communications
You agree that we may send order, shipping, return, and account notices to the email address provided at checkout. Legal notices to us must be sent to service@shopcaivera.com or to the mailing address in Section 1.

20. Governing Law and Disputes
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules, except where consumer-protection laws of your state of residence require otherwise.

Before filing a claim, you agree to email service@shopcaivera.com with a brief description of the dispute and to allow 30 days for us to attempt to resolve it.

If a dispute is not resolved, courts located in Pennsylvania shall have jurisdiction, except where applicable law gives you the right to bring a claim in your county of residence. You and we each waive a jury trial to the extent permitted by law.

Nothing in these Terms limits your rights under mandatory consumer-protection statutes.

21. Changes
We may update these Terms from time to time. The “Last updated” date will change when we do. The version posted on this page when you place an order applies to that order. If you continue to use the site after changes are posted, you accept the revised Terms for future use.

22. Severability and Entire Agreement
If a provision of these Terms is found unenforceable, the remaining provisions remain in effect. These Terms, together with the policies listed in Section 2 and the information presented at checkout, are the entire agreement between you and us regarding the site and your order. Our failure to enforce a provision is not a waiver.
